1. Agreement to Terms

By accessing or using DesertDetector ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). DesertDetector is a proprietary platform owned and operated by Felix Villar ("Owner"), a sole proprietor conducting business as DesertDetector. If you do not agree to these Terms, you may not access or use the Platform.

2. Legal Ownership & Business Entity

DesertDetector is the exclusive intellectual property of Felix Villar. All rights, title, and interest in and to the Platform, including but not limited to all software, algorithms, AI models, data analytics methodologies, trademarks, trade names, service marks, logos, domain names, and all associated intellectual property rights, are and shall remain the sole and exclusive property of Felix Villar.

No part of this Platform may be reproduced, distributed, modified, transmitted, reused, downloaded, reposted, or otherwise used without the express prior written consent of Felix Villar, except as expressly provided herein.

3. Description of Services

DesertDetector provides AI-powered neighborhood service desert analysis, resident demand pledging, and premium market reports for entrepreneurs, lenders, and commercial real estate professionals. The Platform aggregates hyper-local demand data to identify underserved markets and connect communities with business opportunities.

4. User Accounts & Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

5. Pledges & Financial Commitments

Pledges made through the Platform represent non-binding expressions of interest and anticipated future spending. Pledges do not constitute legally binding financial obligations, contracts, or guarantees of payment. DesertDetector and Felix Villar make no representations or warranties regarding the fulfillment of pledges by users or the establishment of businesses based on aggregated demand data.

6. Premium Reports & Payments

Premium market reports are available for purchase at prices ranging from $500 to $2,000 depending on the tier selected. All sales are final. Reports are generated using AI analysis and aggregated platform data. While we strive for accuracy, reports are provided "as-is" and should not be the sole basis for business or investment decisions.

7. Intellectual Property Rights

All content, features, and functionality of the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, AI algorithms, and software, are the exclusive property of Felix Villar and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Data Usage & AI Learning

By using the Platform, you consent to the collection and use of anonymized, aggregated data to improve our AI models and service detection algorithms. Individual user data will not be sold to third parties. Aggregated, de-identified market data may be included in premium reports sold to entrepreneurs and lenders.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Felix Villar and DesertDetector shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Platform.

10. Indemnification

You agree to indemnify, defend, and hold harmless Felix Villar and DesertDetector from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Platform.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where Felix Villar conducts business.

12. Modifications

Felix Villar reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform following any changes constitutes acceptance of those changes.
